Terms and Conditions
(Incorporating Acknowledgement of Medical Services and Guarantee)
Consent and Agreement binding
By indicating my acceptance of these terms and conditions, I hereby:
- consent to the medical services to be rendered to myself and, to the extent I am not the patient, the patient, as his or her guardian;
- agree to the terms, conditions and provisions herein set out; and
- acknowledge, having read and understood these terms and conditions, which constitute and record a legally binding and enforceable agreement by and between the medical practise, S Holt Incorporated (“SHI”), and myself.
Important
SHI is dedicated to providing an efficient and effective service to its patients and to this extent if I, as patient or guardian, as the case may be,:
- feel that this is not the case, I am free to contact SHI on its info email address (info@shihealthcare.co.za) to register my satisfaction or dissatisfaction with the service; and/or
- wish to register a complaint against any member of the SHI practice or supporting doctors for ethical or professional reasons, I can do so by contacting the Health Professions Council of South Africa (Tel no. 012 338 9300).
Fees and Costs for Services
I accept that the fees payable for the consultation I am to receive is paid for by a third party and, as such, there are limitations and restrictions on the extent of such consultation or any further consultations or treatment. The services or package of services available to me by SHI are limited to the extent:
- provided for in the package or service subscribed for or agreed to by me with the applicable third party provider through whom the package was acquired; and
- agreed to by and between SHI and the applicable third party provider through whom the package was acquired.
Claims
SHI will not be liable, directly or indirectly, for any loss, damages, costs and/or expenses directly or indirectly sustained by myself and/or the patient as a result of the services so rendered and that I/the patient hold SHI harmless against all and/or any damages and/or losses incurred by me/the patient as a consequence of any claim arising from the services so rendered, hereby waiving all such claims against SHI.
Consumer Protection Act
Insofar as any of the provisions contained herein are in conflict with any of the laws of South Africa, including but not limited to the Consumer Protection Act, 2008 (Act No.68 of 2008), as amended, for the time being in force, such provisions will be deemed to be amended only to the extent necessary to comply with the provisions of such laws.
Patient Information, Medical Information and Personal Information
By indicating my acceptance of these terms and conditions, I hereby:
- acknowledge, understand and accept, with full awareness, that, pursuant to and in consideration for the third party provider paying my and the patient’s fees and costs of the services to be rendered by SHI to me or the patient, as the case may be, I have agreed to the release and disclosure of my and the patient’s (as the case may be) medical, confidential, private and personal information to the said third party provider and such other persons mentioned below, if and where applicable;
- authorise and instruct SHI, being an express consent, to release, disclose and/or share my and the patient’s (as the case may be) medical, confidential, private and personal information, if and where applicable, to:
- the said third party provider;
- my medical scheme and/or insurers;
- SHI’s medical colleagues involved in my or the patient’s consultation or treatment;
- SHI’s administration division or outsourced provider for the purposes of submitting and receiving and remitting payments;
- SHI’s administration division or outsourced provider for the purposes of receiving, sending, transferring, storing or processing information pertaining to services offered by SHI; and/or
- a hospital group for the purposes of current or future admission.
I am aware and understand that:
- the reasons and purpose for releasing, disclosing and/or sharing my and the patient’s (as the case may be) medical, confidential, private and personal information is to provide the aforegoing persons, including but not limited to the third party provider, with sufficient information upon which to (i) assess the nature, scope, extent and effect or outcomes of the services to be rendered by SHI; and (ii) develop such other services and products that may improve, add to and/or be best suited for my or the patient’s treatment and quality of healthcare;
- the consequences of releasing, disclosing and/or sharing my and the patient’s (as the case may be) medical, confidential, private and personal information could be (i) the improvement of the rendering of quality healthcare; (ii) the receiving, sending, transferring, storing or processing of the aforestated information and the inherent risks associated therewith and
- the Protection of Personal Information Act, 2013 (Act No. 4 of 2013), as amended, provides that special personal information, such as religious beliefs, race, health or sex life, and biometric information may be processed by a health/medical professional, healthcare institutions or facilities or social services, if such information is necessary for the proper treatment and care for the data subject or patient for the administration of the institution or professional practice concerned.
Marketing
I consent to receiving marketing information from SHI and its partner or affiliated companies.
